Terms and Conditions

of the Prize Draw

§ 1 Prize Draw
The prize draws are organised by Dithmarschen Tourismus e.V. (DT) in cooperation with various partners (co-operating partners), who generally provide the prizes for the prize draws (prize sponsors). DT acts on behalf of the cooperation partners during the running of the prize draw and promises the prizes donated by them solely in their name. DT is not thereby obliged to provide any service of its own, unless it is itself the sponsor of the prize in the specific case. The cooperation partners’ General Terms and Conditions, Travel Terms and Conditions and Rules of Use shall always apply to the prizes.

§ 2 Participation
(1) Only adults are eligible to participate. Minors require the consent of their legal guardian to take part, unless this is expressly excluded.
(2) A person takes part in the competition by correctly answering the question posed on the website and following the further procedure. Participants are personally responsible for the accuracy of their details, in particular their email address and postal address. Entries must be received within the deadline specified in the competition.
(3) It is essential for participation in the competition that all personal details provided are true. Failure to do so may result in exclusion in accordance with § 3 (4).
(4) Each individual is only entitled to enter once. Failure to comply may result in exclusion in accordance with § 3 (2).
(5) By submitting their entry via email or post, the participant agrees to the terms and conditions.
(6) Participants are free at any time to request the deletion of their data by sending a revocation notice to [Insert Email/Link] and thereby withdraw from the competition.

§ 3 Exclusion from the competition
(1) Employees of DT and the participating partners, as well as their respective family members, are excluded from taking part.
(2) In the event of a breach of these terms and conditions, DT reserves the right to exclude individuals from the competition.
(3) Persons who use unauthorised aids or otherwise gain an advantage through manipulation shall also be excluded. Where applicable, prizes may also be revoked and reclaimed retrospectively in such cases.
(4) Anyone who provides false personal details may be excluded from the competition.
(5) Entry via competition agencies or other third parties, whether they charge a fee for their services or operate free of charge, is not permitted.

§ 4 Conduct and Administration of the Competition
(1) Winners will be notified in writing by DT and may be published by name on www.echt-dithmarschen.de, on social media channels (Facebook) and/or on the website of the relevant cooperation partners. The winner expressly consents to this form of publication. DT is entitled to pass on the winner’s details to the partner organisation in order to facilitate the delivery of the prize.
If DT only has the winner’s email address, the winner will be notified by email. If the winner does not respond within four weeks of the notification being sent, their claim to the prize will lapse and a new winner will be drawn at random. The claim to the prize shall also lapse if the prize cannot be delivered within one month of the first notification of the win for reasons attributable to the winner.
(2) The item presented as the prize in the competition is not necessarily identical to the item won. Rather, there may be differences in terms of model, colour or similar. The prize sponsor may select an item of equivalent value, standard and quality to the item presented as the prize.
(3) Prizes will be sent to the winner by post to the address provided. The risk passes to the winner upon handover of the prize to a carrier. We are not liable for any damage occurring during delivery.
(4) Under no circumstances is a cash payment of the prize or any substitute prize permitted.
(5) The entitlement to the prize or a substitute prize may not be assigned.
(6) Complaints relating to the conduct of the competition must be addressed in writing to DT, specifying the competition in question, within 14 days of the reason for the complaint becoming known. Complaints made by telephone or submitted late will not be processed.

§ 5 Early termination of the competition
DT reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. DT shall make use of this option in particular if, for technical reasons (e.g. viruses in the computer system, tampering or faults in the hardware and/or software) or for legal reasons, the proper conduct of the competition cannot be guaranteed. If such termination is caused by the conduct of a participant, DT may claim compensation from that person for any loss incurred.

§ 6 Data Protection
DT undertakes to comply with the statutory provisions on data protection. In particular, reference is made in this context to the General Data Protection Regulation. The personal data provided may be used by DT for advertising purposes or to contact participants. The participant expressly agrees that the data they have provided may be collected and processed by the organiser for the purpose of conducting and administering the competition, and may be passed on to third parties (e.g. the post office, a courier service). The participant also agrees that, in the event of a win, they may be contacted by the organiser or a partner organisation. Once the competition has ended, all data provided by the participant will be deleted.

§ 7 Liability
(1) DT shall be released from all obligations upon handover of the prize, unless an earlier date is already specified in these terms and conditions.
(2) DT shall not be liable for any material defects and/or defects of title in the prizes donated by the partner organisation.
(3) DT shall not be liable for the insolvency of a cooperation partner or for any consequences arising therefrom in relation to the organisation and administration of the competition.
(4) DT shall only be liable for damage caused by DT or one of its vicarious agents through wilful misconduct or gross negligence, or through a breach of fundamental obligations. This shall not apply to damage resulting from injury to life, limb and/or health. The above limitation of liability applies in particular to damage caused by errors, delays or interruptions in the transmission of data or similar, in the event of malfunctions of technical equipment or the service, incorrect content, loss or deletion of data, or viruses.

§ 8 Miscellaneous
(1) Legal recourse is excluded.
(2) The law of the Federal Republic of Germany shall apply exclusively.
(3) Should any of these provisions be or become invalid, the validity of the remaining terms of use shall remain unaffected.
(4) These terms of use may be amended by DT at any time without separate notice.
